Are there any restrictions or special conditions for certain user groups?
Certain user groups may be subject to additional requirements or specific conditions arising from legal obligations, the respective user role, and the concrete use case, while the data intermediation service is fundamentally designed to ensure equal treatment and non-discriminatory access for all users.
Principle of equal treatment
The data intermediation service is provided in a transparent, neutral, and non-discriminatory manner in accordance with the EU Data Governance Act, with no unequal treatment regarding access, conditions, or pricing based on sector, organisational form, economic capacity, or data content.
Differences by user role
Depending on whether the service is used as a data holder, data user, or service provider, different functional requirements and contractual obligations apply, in particular with regard to responsibilities, access rights, and permitted processing purposes, without resulting in preferential or disadvantageous treatment of specific user groups.
Regulatory and legal constraints
For certain categories of data, especially personal, sensitive, or legally protected data, additional legal requirements may apply that restrict access or processing, with such restrictions deriving solely from applicable law rather than from selective treatment of individual users.
Uniform access requirements
Access to the service is based on uniform technical and organisational requirements, in particular standardised identity and authorisation mechanisms, ensuring that all eligible users can access the data intermediation service under comparable conditions.
Support-oriented models and exceptions
Any reduced-fee or support-oriented models, for example for start-ups, research organisations, or non-profit entities, are designed in an open, transparent, and cost-oriented manner and are available to all comparable organisations under the same conditions, without compromising the neutrality and purpose-limitation requirements of the Data Governance Act.
Enforcement and exclusion
Failure to meet the applicable legal or contractual conditions or violations of the terms of service may result in restricted access to or exclusion from the service, with such measures being applied on the basis of objective, transparent, and uniformly applicable criteria.
